2. THE CONTRACT

2.1. When you place an order with GUVNOR, you are offering to purchase a product on and subject to the following terms and conditions.

2.2. All orders are subject to availability and confirmation of the order price.

2.3. A contract between us will not be formed until we send you confirmation by email that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation email sent at the time of dispatch will be included in the contract formed.

3. THE GUVNOR LIFETIME WARRANTY

We build kit to last. To prove it, we offer a Lifetime Warranty on Workmanship.

3.1. What is Covered:

We warrant our products to be free from defects in workmanship and materials for the practical lifetime of the product. This specifically covers:

  • Seam failure (stitching unravelling).

  • Hardware failure (buttons, snaps, zippers breaking or detaching due to manufacturing faults).

  • Fabric flaws present at the time of purchase.

3.2. What is NOT Covered:

We do not cover damage caused by accident, improper care, negligence, normal wear and tear, or the natural breakdown of colors and materials over extended time and use. Specifically:

  • Fading, bobbling, or fraying cuffs/collars due to regular use.

  • Damage from washing at incorrect temperatures or using bleach.

  • Rips or tears caused by external objects (e.g., catching a sleeve on a fence).

3.3. Our Remedy:

In the event of a valid warranty claim, GUVNOR reserves the right to take the following actions in this order:

  1. Repair: We will professionally repair the item to restore functionality.

  2. Replace: If repair is not possible, we will replace the item with the same or nearest equivalent product.

  3. Credit: If the item is discontinued, we will issue a store credit for the current value.

3.4 The Original invoice must be provided as proof of purchase, only first owners are entitled to make a claim under the lifetime warranty.

4. PRICING AND PAYMENT

4.1. All prices are inclusive of VAT (where applicable) at the current rates.

4.2. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

4.3. We reserve the right to refuse to fill any orders that you place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

5. DELIVERY

5.1. Dispatch vs. Delivery: We aim to dispatch all orders placed before 2:00 PM (Mon-Fri) on the same day. However, "Next Day Delivery" services are aims, not guarantees, provided by our courier partners (Royal Mail/DPD). We are not liable for delays caused by the courier.1

5.2. Lost Items: If an item is lost in transit, we will not issue a refund or replacement until 10 2working days have passed from the dispatch date, in line with Royal Mail's classification of a "lost" parcel.

6. RETURNS AND CANCELLATIONS

6.1. Your Right to Cancel:

Under the Consumer Contracts Regulations, you have the right to cancel your order within 14 days without giving any reason. At GUVNOR, we extend this period to 30 days from the day on which you receive the goods.

6.2. Condition of Returns:

Items must be returned to us in a new, unworn, and unwashed condition, with all original tags attached. We reserve the right to refuse a refund if the item:

  • Smells of smoke, perfume, or deodorant.

  • Shows signs of wear or washing.

  • Is covered in animal hair.

6.3. Return Shipping Costs:

  • Defective/Wrong Item: If the item is faulty or we sent the wrong thing, we will pay for the return postage.

  • Change of Mind: If you simply want to exchange for a different size or colour, or want a refund, you are responsible for the cost of returning the item to us. We recommend using a tracked service.

7. INTELLECTUAL PROPERTY

7.1. You acknowledge and agree that all copyright, trademarks, and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us.

7.2. Specifically, the name "GUVNOR", the hexagonal Union Jack badge design, and our logo are the exclusive property of our brand. You are strictly prohibited from using these marks without our express written permission.

8. LIMITATION OF LIABILITY

8.1. Nothing in these Terms shall limit or exclude our liability for:

(a) Death or personal injury caused by our negligence;

(b) Fraud or fraudulent misrepresentation;

(c) Any breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession); or

(d) Defective products under the Consumer Protection Act 1987.

8.2. Subject to clause 8.1, we will under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Contract for:3

(a) Any loss of profits, sales, business, or revenue;

(b) Loss or corruption of data, information or software;

(c) Loss of business opportunity;

(d) Loss of anticipated savings;

(e) Loss of goodwill; or

(f) Any indirect or consequential loss.

8.3. Subject to clause 8.1, our total liability to you in respect of all other losses arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the purchase price of the Products you purchased.

SECTION: LIMITATION OF LIABILITY & NATURE OF GOODS

1. Nature of Goods (Not PPE) While Guvnor products are manufactured to high standards of durability, warmth, and quality, they are sold as lifestyle and outdoor apparel only. Unless explicitly stated in the product description with a corresponding CE Certification rating, our products are NOT classified as Personal Protective Equipment (PPE) under UK or EU regulations.

  • For Motorcyclists: Our apparel does not provide impact or abrasion protection equivalent to certified motorcycle leathers or armour. It is designed to be worn for warmth and style, or as a mid-layer unless otherwise certified and labelled as such.

  • For Security/Industry: Our apparel is not stab-proof, cut-resistant, or fire-retardant unless specifically certified and labelled as such.

2. Assumption of Risk By purchasing Guvnor products, you acknowledge that participation in outdoor activities, motorcycle riding, football attendance, and manual labour involves inherent risks of injury or damage. You agree that Guvnor is not responsible for any physical injury, death, or property damage that occurs while wearing our products, provided such injury was not caused by our direct negligence.

3. Limitation of Liability To the fullest extent permitted by English law:

  • Guvnor shall not be liable for any indirect, incidental, or consequential damages arising from the use or misuse of our products.

  • Guvnor's total liability for any claim arising out of or relating to our products shall not exceed the purchase price paid for the specific item that gave rise to the claim.

4. Product Care & Durability We provide a Lifetime Warranty on manufacturing defects (stitching, zips, hardware). However, we are not liable for failure of the product due to:

  • Normal wear and tear (e.g., fabric thinning over time).

  • Accidental damage (e.g., tears from fences, road rash, burns).

  • Improper care (e.g., washing at incorrect temperatures).

9. EVENTS OUTSIDE OUR CONTROL (FORCE MAJEURE)

9.1. We will not be liable or responsible for a9ny failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control.

9.2. An "Event Outside Our Control" means any act or event beyond our reasonable control, including without limitation:

  • Strikes, lock-outs, or other industrial action by third parties (including Royal Mail or Courier strikes).

  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster.

  • Failure of public or private telecommunications networks (including internet service provider outages).

  • The acts, decrees, legislation, regulations, or restrictions of any government.

9.3. If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:

(a) We will contact you as soon as reasonably possible to notify you; and

(b) Our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.1011

10. CHANGES TO THESE TERMS

10.1. We reserve the right to revise and amend these Terms from time to time to reflect changes in market conditions affecting our business, changes in technology, chanes in payment methods, changes in relevant laws and regulatory requirements, and changes in our system's capabilities.

10.2. You will be subject to the policies and terms in force at the time that you order products from us, unless any change to those policies or these Terms is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these Terms before we send you the Dispatch Confirmation.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with English Law. Disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.
